85. Kitaab Farayaiz ka bayan (laws of inheritance)

BADGUMAANI, GEEBATH SE BACHOU:

Muhammed("salla Allaahu'alayhi wa salaam")Farmaay badgumani se bachtay raha karo, kyun kay Guman (badtini) subse Jhooti baath hai, Apas mein ek dosre ki burai kay talaash mein na lagay raho na Ek Dosre se boghz rakho aur na peet pechay kisi ki burai karo, balkay Allah kay banday bhai bhai bankay raho.

[SAHIH AL BUQHARI:8: 6724]

Narrated Abu Huraira:
Allah's Messenger (ﷺ) said, 'Beware of suspicion, for it is the worst of false tales and don't look for the other's faults and don't spy and don't hate each other, and don't desert (cut your relations with) one another O Allah's slaves, be brothers!"


ہم سے موسیٰ بن اسماعیل نے بیان کیا ، کہا ہم سے وہیب نے بیان کیا ، کہا ہم سے عبداللہ بن طاؤس نے بیان کیا ، ان سے ان کے والد نے اور ان سے حضرت ابوہریرہ رضی اللہ عنہ نے بیان کیا کہ رسول کریم صلی اللہ علیہ وسلم نے فرمایا بدگمانی سے بچتے رہو ، کیونکہ گمان ( بدظنی ) سب سے جھوٹی بات ہے ۔ آپس میں ایک دوسرے کی برائی کی تلاش میں نہ لگے رہو نہ ایک دوسرے سے بغض رکھو اور نہ پیٹھ پیچھے کسی کی برائی کرو ، بلکہ اللہ کے بندے بھائی بھائی بن کر رہو ۔



PAIGHAMBARO KI WIRASAT NAHI HOTI:

Muhammed("salla Allaahu 'alayhi wa salaam") Farmaay, kay Humari wirasat nahi hoti, Hum Jo kuch bhi chodhay wo Sadqa hai.

[SAHIH AL BUQHARI:8: 6727]

Narrated `Aisha:
The Prophet (ﷺ) said, "Our (Apostles') property should not be inherited, and whatever we leave, is to be spent in charity."

ہم سے اسماعیل بن ابان نے بیان کیا ، کہا ہم کو عبداللہ بن مبارک نے خبر دی ، انہیں یونس نے ، انہیں زہری نے ، انہیں عروہ نے اور ان سے حضرت عائشہ رضی اللہ عنہا نے کہ نبی کریم صلی اللہ علیہ وسلم نے فرمایا ہماری وراثت نہیں ہوتی ہم جو کچھ بھی چھوڑیں وہ صدقہ ہے ۔



MUHAMMED(ﷺ) KA WIRASAT KA BAYAN:

Muhammed("salla Allaahu 'alayhi wa salaam") Farmaay, Meri Wirasat Dinar ki shakal mein taqseem nahi hoga, mein ne Apni Biwiyou kay kharchay aur Apnay Amilou ki Ujrath kay badh Jo kuch chodha hai wo sadqa hai.

[SAHIH AL BUQHARI:8: 6729]

Narrated By Abu Huraira : Allah's Apostle said, "Not even a single Dinar of my property should be distributed (after my deaths to my inheritors, but whatever I leave excluding the provision for my wives and my servants, should be spent in charity."

ہم سے اسمٰعیل بن ابی اویس نے بیان کیا کہا ہم سے امام مالک نے انہوں نے ابوالزناد سے انہوں نے اعرج سے انہوں نے ابوہریرہ سے کہ رسول اللہﷺ نے فرمایا میرے وارث لوگ اگر میں ایک اشرفی بھی چھوڑ جاؤں اس کو تقسیم نہیں کر سکتے بلکہ جو جائیداد میں چھوڑ جاؤں اس میں سے میری بی بیوں اور عملہ کا خرچہ نکال کر جو بچے وہ سب اللہ کی راہ میں خیرات کیا جائے ۔



MOMINOU KI EHMIYATH:

Muhammed("salla Allaahu 'alayhi wa salaam") Farmaay Mein Mominou ka khud unse ziyada Haqdar hoon pus Unme se jo koi kharzdar marega aur adaigi kay liye kuch na chodhega toh Humper uski adaigi ki zemedari hai aur jisne koi maal chodha hoga wo uskay wareesou ka hessa hai.

[SAHIH AL BUQHARI:8: 6731; SAHIH MUSLIM :3944,3946,3947; SUNAN ABI DAWUD:2900]

Narrated By Abu Huraira : The Prophet said, "I am more closer to the believers than their own selves, so whoever (of them) dies while being in debt and leaves nothing for its repayment, then we are to pay his debts on his behalf and whoever (among the believers) dies leaving some property, then that property is for his heirs."

ہم سے عبدان نے بیان کیا کہا ہم سے عبداللہ بن مبارک نے خبر دی کہا ہم کو یونس بن یزید ایلی نے انہوں نے ابن شہاب سے کہا مجھ سے ابوسلمہ بن عبدالرحمٰن نے بیان کیا انہوں نے ابوہریرہ سے انہوں نے نبیﷺ سے آپؐ نے فرمایا میں مسلمانوں پر خود ان کی جان سے زیادہ حق رکھتا ہوں ( ان پر خود ان سے زیادہ مہربان ہوں) اگر کوئی مسلمان مر جائے، اور قرض داری چھوڑ جائے ادائی کے لیے جائیداد نہ ہو تو ہم اس کا قرضہ ( بیت المال سے) ادا کریں گے اور جو مسلمان مال و دولت چھوڑ جائے وہ اس کے وارثوں کا حق ہو گا ۔

MIRAS KAY BATNAY KA BAYAN:

Muhammed("salla Allaahu 'alayhi wa salaam")Farmaay Miras uskay haqdarou takh pohancha do aur Jo kuch baqhi bachay wo subse ziyada khareebi mard ka hessa hai.

[SAHIH AL BUQHARI:8: 6732;SAHIH MUSLIM: 3929-3931; SUNAN ABI DAWUD: 2898; JAMI AT TIRMIDHI:2098; SUNAN IBN MAJAH:2740]

Narrated By Ibn 'Abbas : The Prophet (ﷺ) said, "Give the Fara'id (the shares of the inheritance that are prescribed in the Qur'an) to those who are entitled to receive it. Then whatever remains, should be given to the closest male relative of the deceased."

ہم سے موسیٰ بن اسمٰعیل نے بیان کیا کہا ہم سے وہیب نے کہا ہم سے عبداللہ بن طاؤس نے انہوں نے اپنے والد سے انہوں نے ابن عباس سے انہوں نے نبیﷺ سے آپ نے فرمایا ذوی الفروض ( یعنی حصہ والوں ) کو ان کا مقرری حصہ دے دو جو مال ( ان کا حصہ دے کر ) بچ رہےوہ قریب کے مرد رشتہ دار ( یعنی عصبہ ) کا ہے ۔

ABU BAKER SIDDIQ(R.A)SE MUHAMMED( ﷺ) KI MOHABBATH:

Muhammed("salla Allaahu 'alayhi wa salaam")Agar mein Is Ummath kay Kisi Admi ko "Khalil" banata, toh unko (Abu baker Siddiq(r) ko) ko khalil banata, lekin Islam ka taluq hi Subse bahetar hai toh usme Muhammed(ﷺ ) ne Dada ko Baap kay darjay mein rakha hai.

[SAHIH AL BUQHARI:8: 6738]

Narrated By Ibn 'Abbas : The person about whom Allah's Apostle said, "If I were to take a Khalil from this nation (my followers), then I would have taken him (i.e., Abu Bakr), but the Islamic Brotherhood is better (or said: good)," regarded a grandfather as the father himself (in inheritance).

ہم سے ابومعمر نے بیان کیا کہا ہم سے عبدالوارث بن سعید نے کہا ہم سے ایوب سختیانی نے کہا انہوں نے عکرمہ سے انہوں نے ابن عباس سے انہوں نے کہا جس شخص کے حق میں رسول اللہﷺ نے یہ فرمایا اگر میں اس امت کے لوگوں میں سے کسی کو جانی دوست بنانے والا ہوتا تو اس کو بناتا لیکن اسلام کی دوستی یہی افضل ہے یا بہتر ہے اس نے ( یعنی ابو بکر صدیق نے ) تو دادا کو باپ کی جگہ رکھا یا یوں کہا دادا کی نسبت یہ حکم دیا کہ وہ باپ
کی طرح ہے ۔

MIRAS BATNAY KA TAREEQA:

Phele Mayyath ki oulad mustahaiq thi aur walidain ko wasiyath ka haq tha- phir Allahtala ne Isme se jo chaha mansuq kardiya aur ladkou ko ladkiyou ka dogna haq diya aur walidain ko unme se har ek ko 6th hessa qarar diya aur biwi ko 8th aur 4th hessay ka haqdar qarar diya aur Shohar ko Adhay ya 4th hessay ka haqdar qarar diya.

[SAHIH AL BUQHARI:8: 6739]

Narrated By Ibn 'Abbas : (During the early days of Islam), the inheritance used to be given to one's offspring and legacy used to be bequeathed to the parents, then Allah cancelled what He wished from that order and decreed that the male should be given the equivalent of the portion of two females, and for the parents one-sixth for each of them, and for one's wife one-eighth (if the deceased has children) and one-fourth (if he has no children), for one's husband one-half (if the deceased has no children) and one-fourth (if she has children)."

ہم سے محمد بن یوسف فریابی نے بیان کیا انہوں نے ورقا یشکری سے انہوں نے ابن ابی نجیح سے انہوں نے عطاء بن ابی رباح سے انہوں نے ابن عباس سے ، انہوں نے کہا ( اسلام کے شروع زمانے میں ) میت کا مال سب اس کی اولاد کو ملتا اور ماں باپ کے لیے جو میت وصیّت کر جاتا وہ ان کو دیا جاتا پھر اللہ تعالیٰ نے اس میں سے جتنا چاہا وہ منسوخ کر دیا اور مرد کو عورت کا دوہرا حصّہ دلایا اور ماں باپ میں سے ہر ایک کو چھٹا حصّہ اور جورو کو آٹھواں حِصّہ ( اگر میّت کی اولاد ہوں ) اور چوتھا حصہ ( اگر اولاد نہیں ہیں ) اور خاوند کو آدھا حِصّہ ( اگر میت کی اولاد نہ ہو ) یا چوتھا حصہ ( اگر میت کی اولاد ہو ) ۔

SIRF BAHEN AUR BETI HO TO UNHAY ADHA ADHA DIYA JAEGA HESSA MIRAS KA:

Maaz bin Jubail(R.A)ne Muhammed("salla Allaahu'alayhi wa salaam")kay zamanay mein ye faisla kiya tha kay adha beti ko milega aur adha bahen ko.

[SAHIH AL BUQHARI:8: 6741;SUNAN ABI DAWUD:2893]

Narrated By Al-Aswad bin Yazid : Mu'adh bin Jabal came to us in Yemen as a tutor and a ruler, and we (the people of Yemen) asked him about (the distribution of the property of) a man who had died leaving a daughter and a sister. Mu'adh gave the daughter one-half of the property and gave the sister the other half.

مجھ سےمحمود بن غیلان نے بیان کیا کہا ہم سے ابوالنضر نے کہا ہم سے ابو معاویہ شیبان نے انہوں نے اشعث بن ابی الشعثاء سے انہوں نے اسود بن یزید سے انہوں نے کہا معاذ بن جبل یمن میں ہمارے پاس آئے لوگوں کو تعلیم دینے کے لیے یا حاکم بن کر ، ہم نے ان سے یہ مسئلہ پوچھا اگر ایک شخص مر گیا اور ایک بیٹی اور ایک بہن چھوڑ گیا تو کیا حکم ہو گا انہوں نے بیٹی کو آدھا مال دلا یا آدھا بہن کو ۔

BAHEN, BETI, AUR POTI HO TOH IS TARHA BATTAY:

Muhammed("salla Allaahu ' alayhi wa salaam")kay faislay kay mutabiq Ladki ko adha, poti ka 6th hessa aur Jo baqhi bachay wo bahen ka hessa.

[SAHIH AL BUQHARI:8: 6742; SUNAN ABI DAWUD:2890; JAMI AT TIRMIDHI :2093; SUNAN IBN MAJAH:2721]

Narrated By Huzail : 'Abdullah said, "The judgment I will give in this matter will be like the judgment of the Prophet, i.e. one-half is for the daughter and one-sixth for the son's daughter and the rest of the inheritance for the sister."

ہم سے عمرو بن عباس نے بیان کیا کہا ہم سے عبدالرحمٰن بن مہدی نے کہا ہم سے سفیان ثوری نے انہوں نے ابوقیس ( عبدالرحمٰن بن غزوان ) سے انہوں نے ہذیل بن شرجیل سے انہوں نے کہا کہ عبداللہ بن مسعودؓ نے ( ابو موسیٰ اشعری کا فتویٰ سن کر ) یہ کہا میں تو اس مسئلہ میں وہی حکم دوں گا جو نبیﷺ نے حکم دیا تھا بیٹی کو آدھا حصہ ملے گا اور پوتی کو چھٹا حصہ اور مابقی بہن کو ( تو بہن عصبہ ہوئی )۔

Muhammed(ﷺ) Farmaay ladka Bistar walay ka haq hota hai.

[SAHIH AL BUQHARI:8: 6751]

. Narrated By 'Aisha : 'Utba (bin Abi Waqqas) said to his brother Sa'd, "The son of the slave girl of Zam'a is my son, so be his custodian." So when it was the year of the Conquest of Mecca, Sa'd took that child and said, "He is my nephew, and my brother told me to be his custodian." On that, 'Abu bin Zam'a got up and said, 'but the child is my brother, and the son of my father's slave girl as he was born on his bed." So they both went to the Prophet. Sa'd said, "O Allah's Apostle! (This is) the son of my brother and he told me to be his custodian." Then 'Abu bin Zam'a said, "(But he is) my brother and the son of the slave girl of my father, born on his bed." The Prophet said, "This child is for you. O 'Abu bin Zam'a, as the child is for the owner of the bed, and the adulterer receives the stones." He then ordered (his wife) Sauda bint Zam'a to cover herself before that boy as he noticed the boy's resemblance to 'Utba. Since then the boy had never seen Sauda till he died.

. ہم سے عبداللہ بن یوسف تنیسی نے بیان کیا کہا ہم سے امام مالک نے انہوں نے ابن شہاب سے انہوں نے عروہ بن زبیر سے انہوں نے حضرت عائشہؓ سے انہوں نے کہا عتبہ بن ابی وقاص ( جب مرنے لگے تو انہوں ) نے اپنے بھائی سعد بن ابی وقاص کو وصیت کی کہ زمعہ بن قیس کی لونڈی ( نام نا معلوم ) کا لڑکا میرا نطفہ ہے تو اس کو اپنے قبضے میں کر لیجیو جس سال مکہ فتح ہوا سعد نے اس لڑکے ( عبدالرحمٰن ) کو لے لیا کہنے لگا یہ میرا بھتیجا ہے ۔ بھائی نے اس کو لینے کی مجھ کو وصیت کی تھی یہ حال دیکھ کر عبد بن زمعہ کھڑے ہوئے کہنے لگے ( واہ واہ ) یہ تو میرا بھائی ہے میرے باپ کی لونڈی نے اس کو جنا ہے ۔ دونوں میں پکڑ ہو گئی اور ایک دوسرے کو لیے ہوئے نبیﷺ کے پاس آئے ۔ سعد نے کہا ، یا رسول اللہ ! وہ میرا بھتیجا ہے ۔ میرا بھائی اس کے مقدمہ میں وصیت کر گیا ہے ۔ عبد بن زمعہ نے کہا وہ میرا بھائی ہے میرے باپ کی لونڈی سے پیدا ہوا ہے ، آپ نے فرمایا عبد بن زمعہ یہ بچہ تو لے لے بچہ اسی کا ہوتا ہے جس کی جورو یا لونڈی کے پیٹ سے پیدا ہوا ہو اور زنا کرنے والے پر پتھر پڑتے ہیں باوجود اس کے آپ نے سودہ بنت زمعہ سے ( جو اس لڑکے کی بہن ہوتی تھیں ) یہ فرمایا کہ تو اس سے پردہ کر ۔ کیونکہ آپ نے دیکھا اس لڑکے کی صورت عتبہ بن ابی وقاص سے ملتی تھی غرض سودہؓ کو اس لڑکے نے مرنے تک نہیں دیکھا ۔

GHULAM AZAD JO KAREGA USSI KO SAWAB MILEGA:

Muhammed("salla Allahu ' alayhi wa salaam")Farmaay, wala usi kay saath khayam hoti hai Jo azad kardien.

[SAHIH AL BUQHARI:8: 6752]

The prophet ( ﷺ) said : The wala is for the manumitted (of the slave )

ہم سے اسماعیل بن عبداللہ بیان کیا ، انہوں نے کہا کہ مجھ سے مالک نے بیان کیا ، ان سے نافع نے اور ان سے ابن عمر رضی اللہ عنہما نے کہا کہ نبی کریم صلی اللہ علیہ وسلم نے فرمایا ولاء اسی کے ساتھ قائم ہوتی ہے جو آزاد کر دے ۔

GHULAM KO AZAD KARANAY JO KHEMATH DEIN WAALA USSI KO MILEGI:

Muhammed("salla Allaahu 'alayhi wa salaam")Farmaay, waala usi kay saath khayam hoti hai Jo khemath dien aur Ehsan kare(Azad karkay)

[SAHIH AL BUQHARI:8: 6760;SUNAN ABI DAWUD:2916; JAMI AT TIRMIDHI:2125]

Narrated By 'Aisha : Allah's Apostle said, "The wala is for the one who gives the silver (pays the price) and does the favour (of manumission after paying the price)."

ہم سے محمد بن سلام نے بیان کیا کہا ہم کو وکیع نے خبر دی انہوں نے سفیان ثوری سے انہوں نے منصور بن معتمر سے انہوں نے ابراہیم نخعی سے انہوں نے اسود سے انہوں نے حضرت عائشہ سے انہوں نے کہا رسول اللہﷺ نے فرمایا ولاء اسی کو ملے گی جو چاندی دے اور احسان کرے ( یعنی آزاد کرے )



GHULAM BHI GHAR KAY EK FARD JAISE HOTA HAI:

Muhammed( "salla Allaahu 'alayhi wa salaam")Farmaay, kisi gharanay ka ghulam usi ghar ka ek fard hota hai.

[SAHIH AL BUQHARI:8: 6761]

Narrated Anas bin Malik:
The Prophet (ﷺ) said, "The freed slave belongs to the people who have freed him," or said something similar.


ہم سے آدم نے بیان کیا ، انہوں نے کہا ہم سے شعبہ نے بیان کیا ، ان سے معاویہ بن قرہ اور قتادہ نے اور ان سے انس بن مالک رضی اللہ عنہ نے بیان کیا کہ نبی کریم صلی اللہ علیہ وسلم نے فرمایا کسی گھرانے کا غلام اسی کا ایک فرد ہوتا ہے ، ” اوکما قال “ ۔





MIRAS MEIN MUSALMAAN KA WARIS KAFIR NAHI HOSAKHTA AUR NA KAFIR KA MUSALMAAN::

. Muhammed("salla Allaahu ' alayhi wa salaam")Farmaay, Musalmaan kafir ka waris nahi hota aur na kafir Musalmaan ka.

[SAHIH AL BUQHARI:8:6764; SUNAN ABI DAWUD:2909; JAMI AT TIRMIDHI:2107; SUNAN IBN MAJAH:2729]

. Narrated By Usama bin Zaid : The Prophet said, "A Muslim cannot be the heir of a disbeliever, nor can a disbeliever be the heir of a Muslim."


. ہم سے ابو عاصم نے بیان کیا انہوں نے ابن جریج سے انہوں نے ابن شہاب سے انہوں نے امام زین العابدین علی بن حسینؓ سے انہوں نے عمر بن عثمان بن عفان سے انہوں نے اسامہ بن زیدؓ سے انہوں نے کہا نبیﷺ نے فرمایا مسلمان کافر کا وارث نہیں ہو گا اور نہ کافر مسلمان کا ۔



JAHANNUMI WO JO APNAY BAAP KI JAGAH KISI AUR KO APNA BAAP KAHAY:

Muhammed("salla Allaahu'alayhi wa salaam")Farmaay, Jis kisi ne Apnay baap kay siva kisi aur kay beta honay ka Dawaah kiya ye jantay huay kay wo uska baap nahi hai toh Jannath usper haram hai.

[SAHIH AL BUQHARI:8: 6767; SAHIH MUSLIM:3928]

Narrated By Sa'd : I heard the Prophet saying, "Whoever claims to be the son of a person other than his father, and he knows that person is not his father, then Paradise will be forbidden for him."

ہم سے مسدد بن مسرہد نے بیان کیا کہا ہم سے خالد بن عبداللہ طحان نے کہا ہم سے خالد بن مہران حذاء نے انہوں نے ابو عثمان نہدی سے انہوں نے سعد بن ابی وقاص سے انہوں نے کہا میں نےنبیﷺ سے سنا آپ فرماتے تھے جو کوئی اپنے اصلی باپ کے سوا اور کسی کو اپنا باپ بنائے جانتا ہے کہ وہ اس کا باپ نہیں ہے تو اس پر بہشت حرام ہو گی ۔


APNAY BAAP KO BAAP MANNAY SE INKAAR KUFR HAI:

Muhammed("salla Allaahu ' alayhi wa salaam")Farmaay, koi Apnay baap ko inkaar na kare kyun kay Jo Apnay baap se mu modhega (Aur Apnay ko Dosre ka beta zahir karta hai toh) ye kufr hai.

[SAHIH AL BUQHARI:8: 6769; SUNAN IBN MAJAH: 2744]

Narrated By Abu Huraira : The Prophet (ﷺ) said, "Do not deny your fathers (i.e. claim to be the sons of persons other than your fathers), and whoever denies his father, is charged with disbelief."

ہم سے اصبغ بن فرج نے بیان کیا کہا ہم کو عبداللہ بن وہب نے خبر دی کہا مجھ کو عمرو بن حارث مصری نے انہوں نے جعفر بن ربیعہ سے انہوں نے عراک بن مالک سے انہوں نے ابوہریرہ سے انہوں نے نبیﷺ سے آپ نے فرمایا تم اپنے باپ دادوں سے منحرف نہ ہو ( دوسروں کو اپنے باپ نہ بناؤ) جو شخص اپنے باپ کو چھوڑ کر دوسرے کو باپ بنائے اس نے ناشکری کی ۔

ZAID BIN HAREES(R.A)AUR UNKAY BETAY USAMA BIN ZAID(R.A)KAY PAOU EK JAISE THE:

Ayesha(R.A)ne bayan kiya kay Ek martaba Muhammed("salla Allaahu ' alayhi wa salaam")mere yahan bohath khush khush tashreef laey, Aap( ﷺ) ka chahera chamak raha tha- Mubammed( ﷺ) ne Farmaaya tumne nahi dekha abhi Mujazziz ne Zaid bin harees aur Osama bin zaid(r) kay (Sirf paou dekhay) aur kaha ye paou ek dosre se taluq rakhtay hai.

[SAHIH AL BUQHARI:8: 6770; JAMI AT TIRMIDHI:2129]

Narrated By 'Aisha : Allah's Apostle ( ﷺ)once entered upon me in a very happy mood, with his features glittering with joy, and said, "O 'Aisha! won't you see that Mujazziz (a Qa'if) looked just now at Zaid bin Haritha and Usama bin Zaid and said, 'These feet (of Usama and his father) belong to each other."

. ہم سے قتیبہ بن سعید نے بیان کیا کہا ہم سے لیث بن سعد نے انہوں نے ابن شہاب سے انہوں نے عروہ سے انہوں نے حضرت عائشہؓ سے انہوں نے کہا کہ رسول اللہﷺ میرے پاس خوش خوش تشریف لائے ، خوشی سے ان کی پیشانی کی بٹیں چمک رہی تھیں فرمایا تو نے دیکھا مجزز بن اعور بن جعدہ مدلجی( جو بڑا قیافہ شناس تھا) اس نے ابھی زید بن حارثہ اور اسامہ بن زید کے قدموں کو دیکھ کر کہا یہ قدم تو ایک دوسرے سے نکلے ہیں ( یعنی باپ بیٹوں کے ہیں)۔
